Terms and Conditions

1. Introduction

Welcome to Fairway Squad ("App"), a community platform for golfers. These Terms and Conditions ("Terms") govern your use of the App, which is owned and operated by Apperate AB ("Company", "we", "us", or "our"), a company registered and seated in Sweden. By accessing or using our App, you agree to be bound by these Terms.

2. Use of the App

Fairway Squad provides tools to manage tournaments, track golf rounds, connect with friends, and trade golf gear. You must be at least 13 years old to use the App. By creating an account, you agree to provide accurate and complete information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials.

3. Infrastructure and Data Storage

Our services are hosted on Microsoft Azure, and we utilize Supabase as our backend database infrastructure. By using Fairway Squad, you acknowledge and agree that your data will be transmitted to, stored, and processed on these platforms in accordance with our Privacy Policy and applicable European Union data protection laws (GDPR).

4. User-Generated Content and Marketplace

When you post content, scores, or list items in the gear marketplace, you retain ownership of your content. However, you grant Apperate AB a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.

Marketplace Disclaimer: Apperate AB is not a party to any transactions between users in the gear marketplace. We do not guarantee the quality, safety, or legality of items listed, nor the ability of sellers to sell items or the ability of buyers to pay for them.

5. Acceptable Use Policy

You agree not to use the App to:

• Violate any applicable local, national, or international law.
• Harass, abuse, or harm other users.
• Post false, misleading, or fraudulent information, including fake golf scores.
• Distribute spam or malicious software.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Apperate AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes by posting the new Terms on the App. Your continued use of the App after any such change constitutes your acceptance of the new Terms.
